Selling a home without a real estate agent?
I am selling my home and do not want to use a real estate agent. I know that some people out there will say that I should, but I already have a buyer, we have agreed on a price and don’t feel we should hire an agent so they can take their commission for nothing (already had a agent try to get me to use them for the paperwork). The question I have is does anyone know where I can find the forms that I need to complete the sell in the state of Texas?

As you have already found a buyer and agreed on a price, you don’t need a agent. Would recommend hiring a lawyer to make sure that all paperwork is done, would probably cost less then a $1000. You definitely do not want to try to do paperwork by guessing.

It is either a real estate lawyer or an agent needs to handle this transaction. You can write up a formal contract that two parties are bound to arbitration and have it notarized.

I think office supply stores like "Staples" and "Officemax" sell blank purchase offers. However, you can simply write the terms of the sale on a piece of paper and have both parties sign it to make it legal.

I agree with the Crow’s remarks – and when I "facilitate" a transaction for clients I only charge $1500 (flat rate taken from clsoing proceeds) I meet with both parties and write up the offer (completely) and then let both parties proceed to closing. Too bad you can’t find a realtor that will simply facilitate for a flat fee (since that’s still better than doing it on your own or in my opinion getting a lawyer) Lawyers do law – they aren’t that good at real estate unless you get an atty specific to it (their paperwork is always over kill) Good Luck! Oh yeah – be sure you check out the buyers financing – hate to see you the day of closing find out they couldn’t get their loan or because of that you missed back up offers on your home.

Hi Martin I am a Realtor in San Antonio TX. and first off I am going to start by defending what I do for a living, we dont "take a commission for nothing" finding a buyer is only the beginning of the sales transaction. we get paid to guide you through the process. to help with the forms, inspection, appraisals, title company, etc.etc. we do more than just find a buyer..we try to make sure that the seller doesn’t get into a legal bind…..now that I got that off my chest…lol I would like to answer your question….
since you’re in TX you need a Tx real estate commission promulgated contract same one I use…you need a One to Four Family Residential Contract (Resale) and while your looking for forms also get a Seller’s Disclosure of Property Condition you’ll need that as well. below is a link to the TX promulgated forms..hope this answers your question and helps you…But if I was you I would get a Realtor, and since you already have a buyer ask for a discount.
